Mr. Stein’s practice is devoted to providing health care practitioners and businesses with comprehensive legal counsel. His prior professional and educational background in health care administration, as well as his focus on servicing the unique legal needs of health care providers, allows Mr. Stein to provide the Firm’s clients with streamlined, global representation.

Mr. Stein’s experience includes representation of physicians, multi-site specialty pharmacies, urgent care centers, management service organizations, home health care agencies, and mental health clinics. He provides counsel in health care-specific complex litigation, including PBM audits and terminations of provider participation agreements, Medicare audits and appeals, Medicare/Medicaid fraud investigations, disciplinary proceedings, and RICO and anti-trust claims. Mr. Stein also advises individual and corporate providers on a wide array of health care-oriented transactional and compliance matters, including initial establishment, corporate structuring, sales and mergers, provider and facility licensure, Stark and Anti-Kickback, fee splitting, and the corporate practice of medicine.

Of note, Mr. Stein was part of the Firm’s successful representation of a multi-site specialty pharmacy being threatened with termination by a large PBM. Ultimately, the Firm obtained a favorable settlement agreement, which stipulated that the pharmacy would continue participating in the PBM’s network.

Mr. Stein also advises health care providers on traditional business matters, including commercial transactions and litigation, and provides employment counsel on, amongst others, the Affordable Care Act, anti-discrimination laws, and minimum wage statutes.

Mr. Stein graduated with honors from Cardozo Law School. As a law student, he spent a significant period of time with the Health Care Bureau of the New York State Office of the Attorney General (OAG). There, he litigated enforcement actions against providers, hospitals, and management services organizations, as well as against insurance companies for improper reimbursement denials. Mr. Stein also researched and participated in setting OAG policy positions on issues such as provider reimbursement, corporate healthcare structuring, and oversight of urgent care centers.

Prior to attending law school, Mr. Stein earned a graduate degree in Health Administration and held administrative positions in a hospital, an adult care facility, and a medical billing company. Mr. Stein’s cross-disciplinary experience gives him a unique, practical perspective, and his insight into the day-to-day, operational challenges faced by health care providers has proven a valuable asset to the Firm’s clients.
